Trademark registration
Review of the proposed mark, applicant details, goods/services description, available use evidence and application preparation. A search or filing does not guarantee registration.
Records to prepare
Proposed word/logo; applicant identity and entity details; goods/services; use evidence if claimed.
Discuss this stage ↗Examination objection response
Review of the Registry examination report and preparation of a response addressing the objections raised. The report, service date, application record and evidence guide the response.
Records to prepare
Application number; complete examination report; date received; earlier filings; supporting evidence.
Discuss this stage ↗Trademark opposition and counterstatement
Preparation for an opposition to a published application or a counterstatement responding to an opposition. This is a contested proceeding, distinct from a Registry examination objection.
Records to prepare
Journal entry; notice of opposition if received; application details; service dates; use and ownership evidence.
Discuss this stage ↗Trademark renewal
Review of the registration record, proprietor details, current status and renewal preparation. Late renewal or restoration requires separate review of the record and applicable procedure.
Records to prepare
Registration certificate/number; renewal history; proprietor details; current status and relevant dates.
Discuss this stage ↗Objection and opposition are different
An examination objection is raised during Registry examination. An opposition concerns a challenge to a published application; the response may involve a counterstatement and evidence. Do not treat either as a generic form submission. Bring the actual report or notice, dates and prior filings so the applicable procedure can be checked.
