Preserve the available record

Write down the date, location and basic circumstances using information you know. Collect available police references, vehicle and insurance details and relevant communications. Make clear which records are copies and which are still to be obtained.

Keep medical records, bills and other supporting expense documents together. Do not alter records or publish sensitive medical information online. Ask the advocate which additional records are required for the particular matter.

Discuss the individual claim

The appropriate forum, eligibility, evidence, time limits and any possible amount depend on the circumstances and applicable law. A general website cannot determine responsibility or calculate a reliable entitlement from a short description.

Disclose any insurer communication, settlement document or existing proceeding before taking a further step. Retain copies of documents and acknowledgements, and obtain individual advice about upcoming dates.

Records to organise

  • Available police reference or accident records.
  • Medical reports, treatment records and bills.
  • Available vehicle, insurance and communication records.
  • Documents concerning expenses or loss relevant to the matter.

Bring copies for discussion and keep originals secure. This is a preparation list, not an exhaustive statutory filing checklist.
