Build a document trail
Identify the property precisely using the identifiers recorded in the documents. Collect the available current deed and earlier deeds, agreements and any documents explaining inheritance, partition or authority to transact. Mark gaps in the chain rather than assuming missing documents are unimportant.
Revenue extracts, survey information, tax receipts and encumbrance records may help organise the inquiry, but no single record should be treated as a complete legal title opinion. Explain any mismatch in names, boundaries, extent or survey references to the reviewing advocate.
Explain the proposed transaction
State whether the matter concerns a purchase, a family arrangement, an existing dispute or a proposed loan. Disclose possession issues, notices, litigation and any pending agreement. The necessary review depends on the transaction and the nature of the property.
Obtain current official requirements through the Registration Department where relevant. A checklist cannot confirm marketable title, verify a signature or replace examination of the full facts by an advocate.
Records to organise
- Available current and prior deeds.
- Survey details, property description and available revenue extracts.
- Encumbrance records and tax receipts available to you.
- Sale agreements, payment records and any dispute notices.
Bring copies for discussion and keep originals secure. This is a preparation list, not an exhaustive statutory filing checklist.
Common questions
Does an encumbrance record alone prove title?
It should not be treated as a complete title opinion. Have the full document trail and facts assessed.
Can the checklist verify a property?
No. It helps you organise records for an individual review.
