Preserve context and originals

Keep the original email, message thread or file where possible. Record where it came from and when it was received. A cropped screenshot may omit important context, so keep the underlying record as well as any viewing copy.

Avoid editing files, deleting messages or changing device information in an attempt to make evidence look clearer. Tell the advocate if a record is incomplete, forwarded or obtained from another person.

Share information carefully

Prepare a simple index with dates, a short description and where each original is kept. Share copies only through a private channel agreed with the office. Protect passwords and avoid sending identity documents or entire personal accounts unnecessarily.

The relevance, authenticity, admissibility and procedural requirements for electronic material need individual legal assessment. This guide helps organise information; it does not certify evidence, recover deleted material or authorise access to another person’s account.

Records to organise

  • Original emails, message threads or files available to you.
  • An index of dates, descriptions and source locations.
  • Notes about missing context or forwarded material.
  • Relevant notices or case references explaining the issue.

Bring copies for discussion and keep originals secure. This is a preparation list, not an exhaustive statutory filing checklist.

Common questions

Is a screenshot always sufficient?

Do not assume so. Preserve the original record and ask what proof or procedure is required.

Can I access another person’s account to obtain records?

This guide does not authorise account access. Discuss lawful collection of material with your advocate.
