Case reference — Oriental Insurance Company Limited v. Alagammal and connected appeal, C.M.A.(MD) Nos. 538 of 2024 and 1212 of 2022, 2 November 2026, Justice K.K. Ramakrishnan
Why the award was reviewed
The insurer challenged the award while the injured claimant sought enhancement. The High Court confirmed the finding on negligence and retained ₹8,31,600 for loss of earning power and disability.
How long-term care was assessed
The evidence showed that the claimant needed assistance to move. The Court calculated attendant charges at ₹2,000 a month for 30 years, giving ₹7,20,000 under that head. It removed the earlier composite award and separately awarded ₹50,000 for loss of amenities and ₹75,000 for future medical expenses.
What the appeals changed
The insurer’s appeal was dismissed and the claimant’s appeal was partly allowed. Compensation rose from ₹15,83,750 to ₹20,76,089, with 7.5% annual interest from the claim petition to deposit. The amounts reflect the evidence in this case. The judgment illustrates why care needs and future treatment should be supported and assessed separately.
