Case reference — Rama Pandey and others v. Ram Lal (dead) through LR and others, 2026 INSC 1199, 5 November 2026, Justices S.V.N. Bhatti and N.V. Anjaria
Why the allotment was disputed
The case concerned Plot No. 159 in Basti district. During consolidation, the roadside land went to allottees who acknowledged they held no rights in that plot. The original tenure holders challenged their displacement.
What the courts examined
A site inspection recorded that the plot abutted a main road. The Supreme Court noted that the record did not clearly show proper consideration of its location or valuation and that the revisional authority gave inadequate reasons for reversing the inspection-based decision.
Result and scope
The Supreme Court dismissed the civil appeal and left the Allahabad High Court’s decision in place. The case arose under Uttar Pradesh’s consolidation statute and applicable circulars. Its factual analysis shows the importance of survey records, site inspection and reasons for an allotment.
