A rejection letter is the beginning of the legal enquiry

Families searching for help after an accident insurance claim is rejected often encounter a short reason: the insured was allegedly under the influence of alcohol. That statement can appear decisive, especially when it refers to a hospital record. The actual legal enquiry is more careful. What does the policy exclude? What reliable evidence establishes the excluded condition at the relevant time? Does the material belong to the insured and to the accident under consideration? A recent Tamil Nadu State Consumer Commission order demonstrates why these questions should be examined before a family accepts repudiation as final or assumes that every such exclusion can be defeated.

The case reference and what the Commission decided

Tata AIG General Insurance Co. Ltd. v. G. Sagundala and Others, F.A.No.529 of 2024, was decided on 29 September 2026. The appeal arose from Vellore DCDRC C.C.No.81 of 2023. The deceased had group personal accident cover linked to an SBI account. Following an accident on 9 April 2022 and death on 18 April 2022, the family claimed ₹30 lakh. The insurer relied on an alcohol exclusion. The State Commission dismissed the appeal, maintaining the award with interest, ₹50,000 compensation and ₹25,000 costs. Its reasoning stressed discrepancies in the medical material and the absence of a reliable evidentiary link. It did not declare alcohol exclusions invalid.

The important qualification: a laboratory report is not always compulsory

The Commission discussed IFFCO Tokio General Insurance Co. Ltd. v. Pearl Beverages Ltd., AIR 2021 SC 2277. Its analysis recognised that an insurer need not invariably produce a breathalyser or blood-alcohol test; reliable circumstances may establish the contractual condition. The difficulty in Sagundala was the quality and linkage of the particular records. Accordingly, a claim should not be presented on the simplistic proposition that no laboratory report always means automatic payment. Equally, a medical note should not be treated as beyond examination merely because it uses clinical language. The strength of the evidence must be assessed against the policy wording and the complete record.

Obtain the entire policy, including the group scheme terms

An account holder may have a bank communication mentioning accident cover without possessing the master policy, certificate or exclusion wording. Collect all available insurance documents before evaluating rejection. Identify the insured person, coverage dates, benefit amount and conditions for eligibility. A bank account category may matter to the cover, but the name of a banking product does not replace the insurance contract. Obtain the terms that applied during the relevant policy year rather than assuming that current promotional material is identical. Keep the rejection letter beside the actual exclusion and mark the words on which the insurer relies. This is the foundation for a focused legal response.

Distinguish an allegation, a recorded history and a proved condition

A medical record may contain information supplied by an attendant, a clinical observation, a diagnostic result or a later summary of earlier treatment. These entries do not necessarily carry the same evidentiary weight. Ask which kind of entry supports repudiation and whether the record explains its source. A history of consumption is different from a documented assessment of the condition contemplated by the policy. Conversely, credible clinical material should not be dismissed without a reason. The review should identify what the entry actually establishes, what it leaves unexplained and whether other records support or contradict it. Accuracy is more useful than selecting only favourable words from a long hospital file.

Identity and timing can be as important as the reported figure

When a numerical test result is relied upon, the surrounding particulars matter. Check the patient’s name, hospital number, age, sample date, admission time and reporting time. Compare the original result with the discharge or death summary. If there are differences, list them in a neutral schedule and seek an explanation from the proper record custodian. Do not assume that every clerical discrepancy destroys a medical record; some can be explained. The question is whether the discrepancy affects the connection between the evidence, the insured and the relevant event. Preserve the unaltered records so that a correction or clarification can be evaluated against the original document.

Keep the accident chronology separate from the insurance dispute

Prepare one chronology for the accident and treatment and another for the insurance claim. The first can include the accident intimation, admission, transfers between hospitals and death. The second can record claim submission, requests for documents, replies and rejection. This separation helps avoid confusion between a fact about the accident and an administrative event occurring months later. A police record, medical document and insurer letter may describe different stages and may have been prepared for different purposes. Read them together without treating any single document as a substitute for the complete enquiry. If a date is uncertain, record that uncertainty rather than filling the gap with an assumption.

The insurer’s reason must be answered specifically

A complaint should identify the exact basis of repudiation and explain why that basis is disputed. If the insurer relies on a particular hospital entry, the response should address that entry. If it relies on a policy clause, reproduce or accurately describe the relevant clause and explain how the facts relate to it. General statements about unfair treatment will rarely replace this analysis. Where the family has already supplied a clarification, retain both the request and the response. If further information is genuinely required, respond promptly and preserve proof of delivery. A well-organised correspondence file shows what was asked, what was answered and which point remained unresolved.

Avoid confusing insurance proof with a criminal prosecution

An insurance dispute concerns contractual entitlement and the evidentiary standard applicable to that proceeding. It should not automatically be argued as though the insurer must secure a criminal conviction before invoking an exclusion. The State Commission’s reasoning recognised the role of probabilities in assessing reliable circumstances. At the same time, a lower standard than criminal proof does not permit a decision based on conjecture. For a claimant, the practical task is to show why the available material does not reliably establish the excluded condition. For an insurer, the task is to identify coherent evidence supporting the clause invoked. Keeping the correct enquiry in view improves the quality of the case.

What the order does not establish

Sagundala does not mean that drinking is always covered, that every accident after consumption must be paid, or that an alcohol exclusion can never operate. It does not make every difference between two medical documents fatal to repudiation. It also should not be used to promise the same compensation or interest in another case. The Commission examined a specific policy and a particular documentary record. A different policy definition, coherent hospital material or other reliable evidence can produce a different outcome. A useful awareness article must preserve those limits, because an overbroad headline can mislead a family about the strength of its own claim and the work needed to establish entitlement.

Documents the family should assemble for review

Collect the policy certificate, master-policy terms if available, bank account evidence relevant to eligibility, claim form, acknowledgement, rejection letter and all supporting correspondence. Add the accident record, complete hospital papers, death certificate and documents showing the claimant’s entitlement to seek the benefit. Retain receipts for expenses for which reimbursement or costs are sought. Where a nominee and legal heirs are different persons, obtain advice about the appropriate parties and the relief rather than assuming that one label resolves every question. Index documents chronologically and keep the originals available. Redact unnecessary personal identifiers in public-facing material, while retaining complete copies for confidential legal review.

Quantify the relief without assuming a standard award

Separate the contractual benefit from interest, compensation and litigation costs. Explain the amount insured and any payment already received. Where interest is sought, identify the proposed starting point and the reason for it. Compensation for hardship should be supported by the facts rather than copied from another order. The ₹30 lakh benefit in Sagundala was connected to that insured cover; it is not a general amount available in every accident claim. Likewise, a decision upholding a particular interest direction does not establish an automatic rate for all future complaints. A clear calculation makes the dispute easier to understand and reduces the risk of asking for overlapping recovery.

Where a new consumer complaint belongs

The fact that this decision came from the Tamil Nadu State Commission does not mean every accident insurance complaint should start there. This proceeding was an appeal from a District Commission. The correct forum for a new complaint depends on the governing law, consideration, territorial connection and type of proceeding. Do not use the insured benefit or an ambitious compensation demand as the sole basis for selecting a forum. Identify the relevant premium and policy transaction and obtain advice on the applicable jurisdictional test. The appeal route and an original complaint are different procedural stages. Reading the case heading carefully prevents a useful precedent from becoming an incorrect filing template.

Delay should be assessed before further reminders are sent

A family may spend months asking a bank, agent or insurer to reconsider. Those efforts can be understandable, but they should not be assumed to keep every legal deadline open. Record when rejection was received and whether any later communication actually changed the decision or merely repeated it. Preserve envelopes, delivery reports and emails where receipt dates may matter. If there is a possible delay, seek advice about the available explanation and evidence promptly. Avoid waiting for a perfect file when a deadline may be approaching; missing records and limitation can be addressed as separate issues. A timely assessment helps preserve options without promising that a late complaint will necessarily be entertained.

Questions claimants frequently raise

Can a hospital summary alone ever support an exclusion? Its reliability, specificity and connection to the insured must be examined; there is no safe universal answer. Should an incorrect entry be corrected privately by editing a scan? No; request a proper clarification from the hospital and preserve the original. Does an SBI-linked policy make the bank automatically liable? The roles and documents matter; the bank claim in this particular dispute was dismissed. Can a family challenge repudiation despite a medical reference to alcohol? It can seek a legal assessment, but the strength of the challenge depends on the actual evidence. A recent favourable order is a starting point for analysis, not a guarantee.

A document-based way forward

For families in Vellore, Vandavasi, Tiruvannamalai and nearby areas, the most useful first step is a structured review of the policy, repudiation and medical chronology. SK Law House can help identify the disputed clause, organise the supporting record and assess the appropriate consumer remedy. Bring the complete rejection communication and the documents supplied with the claim so that the legal issue can be examined in context. The purpose of this article is consumer awareness; an individual claim requires an assessment of its own cover, evidence and procedural position.
