A brochure promise can become a serious consumer dispute

When an apartment brochure promises a particular project size, buyers may rely on that promise while assessing open space, density, common facilities and the overall value of their purchase. A later mismatch between the brochure and sanctioned plan naturally raises questions. However, a consumer complaint needs more than a striking comparison between two numbers. The legal question is what was promised, what was actually delivered, and what reliable evidence establishes the difference. A recent National Commission order offers a useful example of that distinction. For homebuyers in Vandavasi, Tiruvannamalai and elsewhere in Tamil Nadu, its strongest lesson concerns the quality of the documentary record.

The recent order and its limited outcome

In Panchkula Heights Resident Welfare Society v. G.S. Promoters and Developers and Another, Consumer Complaint No.1040 of 2017, the NCDRC pronounced its order on 27 October 2026. The dispute concerned a Punjab project advertised as five acres. After examining the local measurement evidence, the Commission accepted an area of 4.81 acres. It awarded ₹10 lakh as notional compensation for the admitted shortfall and ₹25,000 costs, payable within 45 days. The outstanding amount would attract 9% simple interest after that period. The larger ₹5 crore demand and other prayers failed. The compensation was earmarked for members’ welfare or common facilities. This was a partial success, rather than acceptance of every allegation in the complaint.

Why the difference between project land and flat area matters

A buyer should first identify which area is disputed. The land beneath an entire development is different from an individual apartment’s carpet area, built-up area or undivided land share. A complaint can become confused if figures from these separate categories are placed side by side as though they describe the same thing. Prepare a short schedule identifying the document, the term used, the unit of measurement and the relevant property. If the complaint concerns total project land, a measurement of one apartment will not resolve it. If it concerns the apartment itself, the overall development extent may answer a different question. Keeping these categories distinct helps an expert give a useful opinion.

Preserve the brochure that influenced the purchase

Marketing material is often replaced after a project is completed. Preserve the version supplied when the booking was made, including its date, project name, page numbers and any explanatory notes. Retain emails, booking acknowledgements and messages that connect the brochure to the transaction. A screenshot without context may leave room for a dispute about whether it relates to the same phase, tower or development. If the representation was made through a website, preserve the page with the address and date visible. Do not edit the original file to highlight the disputed sentence; make an annotated working copy while retaining the unchanged source. The aim is to show the representation actually encountered by the purchaser.

Compare the complete agreement and sanctioned record

Read the booking form, sale agreement, construction agreement, registered sale deed and sanctioned plan together. A single page may omit a qualification, a phase boundary or an explanation of common facilities. Create a comparison table that records the promised feature and the corresponding contractual or approved description. Ask whether the brochure refers to the entire development while the plan covers one phase. Check whether additional land was proposed for a later stage. Obtain a legible approved plan rather than relying only on a salesperson’s marked sketch. Where different plans exist, record their approval dates and revision history. This comparison should precede a demand for money, because it identifies the precise inconsistency that requires an answer.

Measurement requires a method, not an assumption

The Panchkula Heights dispute illustrates the danger of treating every recorded area expression as self-explanatory. Its discussion of Punjab measurement practices must not be transplanted into Tamil Nadu land calculations. A Tamil Nadu property should be examined using its own registered description, survey particulars, approved layout and applicable local records. Ask the measuring professional to explain the boundaries inspected, instruments used, unit conversions and whether common roads or excluded portions were included. A report that gives only a final number may be difficult to evaluate. Photographs and a plan showing the measured outline can help explain the result. The expert should also identify any limitation caused by inaccessible boundaries or incomplete documents.

Separate a proved shortfall from a compensation estimate

Even after a discrepancy is established, the amount payable remains a separate question. The amount demanded in a complaint is not automatically the amount awarded. Explain how the shortfall affects the promised development, the use of common facilities or the value of the service purchased. Avoid simply multiplying an alleged missing area by an unsupported market rate. A defensible valuation may require evidence about the relevant land, date and nature of the interest affected. If the complaint seeks remedial work rather than money, explain the work and its feasibility. A carefully supported alternative prayer can be more useful than an exaggerated figure that obscures the actual grievance.

An association needs a clear authority to act

A residents’ association should collect its registration record, governing documents, authorising resolution and the basis on which it represents affected purchasers. The October order treated the complaint as one by a voluntary consumer association under the old 1986 Act, rather than a permitted representative class action. That procedural treatment should not be copied mechanically into a new filing under the 2019 Act. The intended complainant, the relief sought and the statutory route require independent examination. An association resolution is useful evidence of authority, but it does not by itself answer every maintainability question. Individual buyers should also preserve their own purchase and payment records, even where a collective grievance is being considered.

Common facilities and ownership are different questions

Requests about common areas may concern ownership, management, access, maintenance or completion of promised work. These are distinct issues. The Punjab statute discussed in this order cannot be presented as the Tamil Nadu rule for all apartment projects. For a Tamil Nadu development, examine the applicable local apartment law, conveyance documents and association arrangements before stating who holds which right. If a builder retains control over a facility, identify the document relied upon and the practical restriction imposed. A complaint seeking completion of a swimming pool calls for a different factual record from one disputing title to the underlying land. Describe the actual problem before selecting the legal remedy.

Keep each additional defect in its own evidence folder

A project-area complaint may also include concerns about electricity, completion certificates, water supply or an administrative block. Each allegation needs its own supporting record. A successful land-shortfall point will not automatically establish a separate utility defect. Obtain the relevant sanction, inspection report, correspondence and dated photographs for each issue. Where an authority has already issued an approval, read exactly what it covers before alleging that no approval exists. If the concern is capacity, an appropriately qualified technical assessment may be needed. This disciplined approach makes it easier to distinguish a missing document from an absent service and a disputed capacity from a proven operational failure.

Act promptly and record when the issue became known

Do not assume that an association complaint can be filed at any time simply because residents continue to occupy the building. Preserve the handover record, the date on which the approved plan was supplied, the date of measurement and the first written objection. These dates help explain when the particular grievance became discoverable. The limitation finding in this order depended on its own history and cannot guarantee the same result in another project. Repeated reminders should not be treated as an automatic extension of time. If there is a possible delay, obtain advice on the explanation and supporting documents before filing, rather than leaving the issue to an unsupported statement in the complaint.

Choose the proper forum for a new complaint

The forum used in this 2017 complaint reflects the law applicable to that proceeding. For ordinary new complaints, the 2021 jurisdiction rules use consideration paid: District up to ₹50 lakh, State above ₹50 lakh up to ₹2 crore, National above ₹2 crore, subject to other applicable provisions. Do not select the National Commission merely because the compensation prayer is large. Territorial jurisdiction, the identity of the complainant and the nature of the relief also need checking. A recent National Commission decision can help explain a legal issue without making every similar local dispute a National Commission case. Filing in the correct forum avoids an unnecessary preliminary contest.

A useful written demand asks precise questions

Before litigation, a well-prepared demand can identify the brochure representation, the contradictory record and the clarification sought. Ask the developer to identify the relevant sanctioned plan, explain the measurement and supply the documents relied upon. Where corrective work is feasible, describe the proposed solution. Preserve proof that the demand reached the correct entity. Avoid accusations of fraud unless the evidence supports that allegation; an unexplained inconsistency should first be stated accurately as an inconsistency. A clear response may narrow the dispute, while an evasive response can help identify the issues requiring adjudication. Keep communications factual and retain complete email threads rather than isolated excerpts.

Questions apartment purchasers commonly ask

Does every brochure mismatch produce a refund? No. The representation, contractual record, actual delivery and proved consequences must be examined. Can a society claim the entire market price of alleged missing land? A demand needs a legal and evidentiary basis; this order did not grant the ₹5 crore sought. Does a disclaimer settle the issue automatically? Its wording and effect require examination alongside the representation and transaction. Can Punjab measurement findings be used to reduce a Tamil Nadu acre? They should not be adopted in that manner. Does a monetary award mean every other project allegation succeeded? No; read the operative directions and rejected prayers separately.

Practical review for Tamil Nadu apartment disputes

A useful case file contains the purchase chronology, brochure, payment trail, complete agreements, registered deed, sanctioned plans, handover papers, association authority and any technical report. Prepare an index that allows each factual allegation to be traced to a document. Keep original records intact and use readable copies for review. SK Law House, Vandavasi, can assess apartment documentation and consumer remedies for purchasers in Tiruvannamalai and surrounding areas. For a document-based review, bring the records showing both the promise and the alleged shortfall. Contact the office through the SK Law House contact page or call 90871 80854 / 97896 98918. This awareness article explains a reported order; the remedy in an individual matter depends on its own documents and procedural position.
