In The General Manager (i/c), Vellore-Tiruvannamalai District Co-operative Milk Producers Union Ltd. v. P.S. Santhanam, decided on August 4, 2026, the Madras High Court held that a cooperative society can withhold terminal benefits while surcharge recovery proceedings are pending against a retired employee.

The case arose from a dispute involving a retired Selection Grade Manager of the Vellore-Tiruvannamalai District Co-operative Milk Producers Union. The employee had retired on October 31, 2014. However, his terminal benefits were not settled because surcharge proceedings had already been initiated under Section 87 of the Tamil Nadu Cooperative Societies Act on allegations that he had caused financial loss to the society.

Two surcharge final orders had earlier been passed for Rs.36,368 and Rs.21,67,940. The employee succeeded before the Special Tribunal for Cooperative Cases, and writ petitions challenging those orders were stated to be pending. During that dispute, a separate writ of mandamus had been allowed directing payment of annual increments and terminal benefits. The Division Bench examined whether such payment could be compelled despite pending surcharge recovery.

Why the High Court interfered

The Bench of Justice S.M. Subramaniam and Justice N. Senthilkumar held that once surcharge proceedings are initiated and final orders are passed, recovery proceedings can follow and the competent authority may attach the properties of the person concerned, including terminal benefits, pending recovery.

The Court further reaffirmed that surcharge proceedings under Section 87 are independent proceedings. It noted that in cases involving financial irregularity, misappropriation, fraud or related misconduct in a cooperative society, separate criminal action, disciplinary proceedings and surcharge proceedings may all be pursued depending on the facts.

The Court also referred to the proviso to Section 87(1) and observed that the limitation for initiating surcharge action is seven years. On the facts before it, the Bench found that the action had been initiated within limitation and saw no legal infirmity on that ground.

Result

The Madras High Court set aside the earlier writ order dated February 21, 2023 in W.P. No. 32350 of 2016 and allowed the writ appeal.

Why this matters

This judgment is important for cooperative societies, retired employees and service-law practitioners in Tamil Nadu. It clarifies that terminal benefits are not automatically insulated from recovery action when valid surcharge proceedings are already in motion. It also underlines that surcharge proceedings have a distinct statutory character and need not wait for the outcome of every parallel proceeding.
